NOTICE OF PUBLIC HEARING
CITY OF MENDOTA
REGULAR MEETING OF THE CITY COUNCIL
NOTICE IS HEREBY GIVEN THAT, on May 5, 2026, at 6:00 p.m., or as soon thereafter as possible, the City Council of the City of Mendota will hold a public hearing at a regular meeting at the Mendota City Council Chambers, 725 Riofrio Street, Mendota, California 93640, to conduct the following business:
- PUBLIC HEARING TO REVIEW AND CONSIDER STATUS OF DEVELOPMENT AGREEMENT DEFAULT, ENTITLEMENTS, AND TERMINATION OF DEVELOPMENT AGREEMENT with ELEMENT 7 MENDOTA, LLC, regarding the construction and operation of a commercial cannabis dispensary located at 796 Oller Street, Mendota, California 93640 (APN 013-191-18). At a regular meeting on March 24, 2026, the Planning Commission voted to recommend the City Council consider: (i) approving an assignment of the development agreement to NUG Inc.; (ii) acceptance of a $50,000 down payment on outstanding fees due under the development agreement with repayment of the remainder in thirty-six monthly installments; (iii) decreasing the $5.00 per square foot charge to $2.50 per square foot; (iv) decreasing the public benefit fee amount to 3% of gross receipts; and (v) amending the development agreement’s social program obligations.
